Orders and Payment Terms

Terms of payment are within Crossbow Warehouse's sole discretion, and unless Crossbow Warehouse has agreed to credit terms with you, payment must be received by Crossbow Warehouse prior to acceptance of or processing an order. Payment for orders must be made online through our payment processor, PayPal, either by credit card, debit card, electronic check, funds transfer from your PayPal account or other payment method accepted by PayPal. Your order is subject to cancellation by Crossbow Warehouse, at Crossbow Warehouse's sole discretion.

Crossbow Warehouse is not responsible for pricing, typographical, or other errors, in any offer and Crossbow Warehouse reserves the right to cancel any orders resulting from such errors.

Crossobw Warehouse receives product descriptions, technical specifications, and other product-related information posted on this website directly from the manufacturer. Crossbow Warehouse is not responsible for any errors or inaccurate claims made by manufacturers.

Shipping, Taxes, Title, and Risk of Loss

Shipping and handling fees are additional unless otherwise expressly indicated at the time of sale. Title and risk of loss passes from Crossbow Warehouse to you when your purchase has been transferred to carrier for delivery to you. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

Any and all non Crossbow Warehouse branded items are provided "as-is" and any third-party warranties, maintenance, service, and support (if applicable) are provided by the manufacturer, and not Crossbow Warehouse. If you purchase third-party-branded items, additional third-party terms and conditions may apply.

Returns and Exchanges

Changed or Discontinued Products

If for whatever reason an item is discontinued or becomes unavailable, this may affect any information you may have stored in your online shopping cart. If changes occur after ordering and the change is due to the release of a new version of the item ordered (with the same name, functionality and price) and the version you ordered is no longer available, you will be shipped the new item. If an item you ordered is discontinued and is no longer available, you will be notified of the change to your order, and the price for the item will be refunded to you.

CROSSBOW WAREHOUSE DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE OR THE PROVISION OF SERVICES AND SUPPORT. EXCEPT AS EXPRESSLY PROVIDED HEREIN, CROSSBOW WAREHOUSE SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT YOU ALONE ARE LIABLE FOR ANY LIABILITY RELATED TO YOUR PURCHASE AND/OR USE OF PRODUCTS PURCHASED FROM CROSSBOW WAREHOUSE. YOU AGREE TO HOLD HARMLESS CROSSBOW WAREHOUSE FROM ANY LIABILITY THAT MAY RESULT FROM THE USE OF ANY PRODUCT PURCHASED FROM CROSSBOW WAREHOUSE, INCLUDING WITHOUT LIMITATION, ANY INJURY OR PROPERTY DAMAGE THAT MAY OCCUR OR BE CAUSED BY THE USE OR MISUSE OF SUCH PRODUCT(S).

IF FOR ANY REASON A RECALL IS ANNOUNCED THAT APPLIES TO ANY NON CROSSBOW WAREHOUSE BRANDED PRODUCT PURCHASED FROM CROSSBOW WAREHOUSE, YOU MUST RETURN THE ITEM TO THE MANUFACTURER FOR WHATEVER REMEDY THAT IS BEING OFFERED. CROSSBOW WAREHOUSE CANNOT ACCEPT RETURNS ON RECALLED ITEMS, NOR CAN CROSSBOW WAREHOUSE FULFILL ANY REMEDY SET FORTH BY MANUFACTURERS.

CROSSBOW WAREHOUSE MAKES NO CLAIMS REGARDING THE MERCHANTABILITY OF NON CROSSBOW WAREHOUSE BRANDED ITEMS SOLD ON THIS WEBSITE. ALL ISSUES ARISING FROM AN ITEM THAT MAY BE DEFECTIVE, OR OTHERWISE DOES NOT LIVE UP TO YOUR EXPECTATIONS, MUST BE TAKEN UP WITH THE MANUFACTURER.

NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, THE REMEDIES SET FORTH IN THIS AGREEMENT SHALL APPLY EVEN IF SUCH REMEDIES FAIL THEIR ESSENTIAL PURPOSE.

Compliance with Applicable Law

You agree to comply with all applicable laws and regulations governing your purchase, possession, and use of any product purchased from Crossbow Warehouse. While Crossbow Warehouse expends a significant effort to know and keep current on the law, it is impossible to know every law everywhere. By purchasing an item from Crossbow Warehouse, you affirm that you are legally allowed to make such a purchase in your jurisdiciton, and agree to hold harmless Crossbow Warehouse of any liability whatsoever, should this prove not to be true.

Not For Resale or Export

You agree and represent that you are buying only for your own internal and/or personal use only, and not for resale or export.

Governing Law, Jurisdiction

The parties agree that this Agreement, any sales thereunder, or any claim, dispute or controversy (whether in contract, tort, or otherwise, whether preexisting, present or future, and including statutory, common law, and equitable claims) between you and Crossbow Warehouse arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement, Crossbow Warehouse's advertising, or any related purchase shall be governed by the laws of the State of Florida, without regard to conflicts of law.

Modification

Crossbow Warehouse reserves the right to modify these terms at any time by updating this web page. You are encouraged to check this page from time to time, as continuing to do business with Crossbow Warehouse shall constitute an acceptance of any new terms.

Termination

You or Crossbow Warehouse may terminate your account at any time for any reason. If such event occurs, you are personally liable for any orders that you placed prior to termination.

Entire Agreement

This Agreement, including any Crossbow Warhouse policies linked to herein constitute the entire Agreement between you and Crossbow Warehouse with regard to your purchases made through this website.
